Trademark Registration

Trademark is a sign that distinguishes the goods and services of one trader from those of others. Typically a trademark can be words (including personal names), indications, designs, letters, characters, numerals, figurative elements, colors, sounds and smells, the shape of the goods or their packaging or any combination of these. A sign must be capable of being represented graphically in order for it to be registered as a trademark.
Registering trademark means that you have the exclusive right to use the trademark in relation to the goods and services for which the mark is registered. If other traders use it in Hong Kong, China in relation to the same or similar goods or services without your consent, they may be liable for infringement of your trademark and you may take legal action. If you do not register your trademark, you may still use it but it is harder to prove that you are the “owner” of the mark and as such your protection is limited.

Trademark Search

A search of trade marks is to see if the same or similar trade mark has already been registered or been applied for by another trader in respect of the same or similar class of goods and services.

Application

After submitted the application, IPD will conduct a search of the trade marks records. It will take 2-3 months for deficiency checking.

Objection

If the requirements for registration are not met during the period of application, IPD will object to the mark. Applicant has 6 months in which to meet the requirements. A further 3 months extension may be granted.

Publication of Trade Mark

If the trade mark satisfies the registration requirements laid down in the Trade Marks Ordinance. It will publish in the Hong Kong Intellectual Property Journal for 3 months.

Opposition

Anyone can view the trade mark in the HK Intellectual Property Journal and lodge an opposition to it. They have to file an opposition notice within the 3-month period beginning on the publication date. Applicant may either withdraw the application or respond the opposition by filing a counter-statement.

Registration

During the period, if there is no objection from 3rd party. The trade mark has been accepted for registration, a Certificate of registration will be issued by the Registrar of Trade Marks. Notice of the registration will be published in the Hong Kong Intellectual Property Journal.
